MINUTES
OF THE MEETING OF THE BOARD OF TRUSTEES
May
20, 2009
The
regular meeting of the Board of Trustees of the Northwest Mosquito Abatement
District was held Wednesday, May 20, 2009 at 7:30 pm.
There
being a presence of a quorum, Arnold D. Kincaid, President called the meeting
to order.
Trustees
present: Arnold D. Kincaid,
President; Daniel R. Ansani, Vice
President and Assistant Secretary; Richard A. David, Secretary and Assistant
Treasurer; William Schneck, Treasurer.
Trustees
absent: Karen V. Mills, Vice President and Assistant Secretary/Treasurer.
Also
present: Donald Veverka, Attorney;
Michael Szyska, Director.
The
minutes of the April meeting were read. Daniel R. Ansani made a motion to accept
the minutes as read and William Schneck seconded the motion.
The
Secretary called the roll and all ayes had been cast for approval of the motion
and thereby declared the motion carried.
The
Treasurer's Report for April 2009 was presented and all checks were approved
for payment. Richard A. David made a
motion to accept the report as read and Daniel R. Ansani seconded the motion.

Daniel
R. Ansani made a motion to accept the Tax Anticipation Ordinance as presented
by Veverka, Rosen & Haugh, Attorneys for the District, and William Schneck
seconded the motion.
WHEREAS,
NORTHWEST MOSQUITO ABATEMENT DISTRICT has levied, in the manner provided by
law, taxes for the year 2009, the sum of $2,438,643.15; and,
WHEREAS,
due to the delay in collection of these taxes, there is not sufficient money in
the Treasury of the District to meet all necessary expenses and liabilities of
the District; and,
WHEREAS, under
these circumstances, the Board of Trustees may anticipate the collection of
said taxes to the extent of seventy-five percent (75%) of the amount of said
levy by the issuance and sale of warrants drawn against and in anticipation of
said taxes already levied;
NOW,
THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE NORTHWEST MOSQUITO
ABATEMENT DISTRICT:
1. That the President of the said Board of
Trustees is hereby authorized to execute and sell from time to time, as funds
are needed for the necessary expenses and liabilities of said District,
Warrants, in One Thousand Dollar ($1,000.00) denominations, drawn against and
in anticipation of taxes levied for the year 2009, in an amount not to exceed
seventy-five percent (75%) of this amount of said taxes. All of said Warrants shall be signed by the
President and countersigned by the Assistant Secretary under the Seal of the
District.
2. That said Warrants shall be payable to bearer
and shall show upon their face that they are payable in numerical order of
their issuance solely from the anticipated taxes when these anticipated taxes
are collected and not otherwise.
3. Each Warrant shall bear interest, payable
only out of the taxes against which it is drawn, at the rate specified in the
Warrants. Said rate of interest shall be
set by the President of the time of the sale of each Warrant and shall not
exceed Two and Eight Tenths Percent (2.80%) per annum from the date of its
issuance until paid or until notice is given, in the manner provided by law,
that payment will be made upon presentation.
4. Said Warrants shall be issued in the
following form:

TREASURER OF NORTHWEST MOSQUITO ABATEMENT DISTRICT:
From taxes
collected under the tax levy for the year 2009, appropriated and levied for
Corporate purposes of NORTHWEST MOSQUITO ABATEMENT DISTRICT when received by
you, pay to Bearer the sum of ______________ Dollars with interest at the rate
of 2.80 Percent per annum from the date hereof until the date of payment or
until notice is given by publication in a newspaper or otherwise that the money
for the payment of this warrant is available and that it will be paid on
presentation. All warrants issued
against and in anticipation of said taxes are payable in the numerical order of
their issuance solely from said taxes when collected and not otherwise. Said warrants including this warrant, do not
exceed seventy-five percent (75%) of the tax levy and shall be received by any
collector of taxes in payment of the taxes against which they are issued.

5. Said Warrants shall be sold at not less than
par value thereof and the funds received shall be deposited with the Treasurer
of the NORTHWEST MOSQUITO ABATEMENT DISTRICT.
6. When the taxes levied for the year 2009 are
collected, the Treasurer of the NORTHWEST MOSQUITO ABATEMENT DISTRICT shall set
apart and hold out sufficient money for the payment of the Warrants outstanding
against said taxes together with interest thereon.
7. This ordinance shall take effect and be in
full force from and after its passage and approval.

Mr.
Veverka reported that the Ethics statements have been filed with the County.
William
Schneck made a motion to pass the following POLICY AS TO FREEDOM OF INFORMATION
REQUESTS and the motion was seconded by Richard A. David.
POLICY AS TO FREEDOM OF
INFORMATION REQUESTS
WHEREAS, the Illinois Legislature has
provided that the public policy of the State of Illinois is that all persons
are entitled to full and complete information regarding the affairs of
government and the official acts and policies of those who represent them as public
officials and employees (5ILCS 140/1) and that each public body shall make
available to any person for inspection and copying all public records (140/3)
unless otherwise provided in §140/7; and,
WHEREAS, the Illinois Legislature has
further provided that the fees to be charged by a public body for responding to
requests under the Act “shall be imposed according to a standard scale of fees,
established and made public by the body imposing them”(§140/6).
NOW, THEREFORE, it shall be the policy of
the NORTHWEST MOSQUITO ABATEMENT DISTRICT (the “DISTRICT”) under the Freedom of
Information Act (the “Act”) as follows:
1.
All requests under the Freedom of Information Act shall be handled in
compliance with 5 ILCS §140/3 to 140/11.
2.
There shall be no charge for any request under the Act which can be
satisfied by a reference or cite to the DISTRICT’S website.
3.
Documents shall be furnished without charge or at a reduced charge, as
determined by the DISTRICT, if the person requesting the documents states the
specific purpose for the request and indicates that a waiver or reduction of
the fee is in the public interest.
Waiver or reduction of the fee is in the public interest if the
principal purpose of the request is to access and disseminate information
regarding the health, safety and welfare or the legal rights of the general
public and is not for the principal purpose of personal or commercial
benefit. In setting the amount of the
waiver or reduction, the DISTRICT may take into consideration the amount of
materials requested and the cost of copying them.
4. Documents
provided pursuant to any requests under the Act, other than as set forth in
Paragraphs 2 and 3 above, shall be charged at $.25 per page or at $.35 per page
if certification is requested.

Mr.
Szyska updated the Board on District operations. The Lab is finding some mosquitoes and to
date none have tested positive for WNV. Mr. Szyska reported that the insurance
policies are bound. The District has
hired all the seasonal employees. The
Accountants have started the fiscal year end audit. There was a discussion regarding the 6th
Circuit Appellate Court’s decision on the Clean Water Act.
There
being no further business to come before the Board a motion was made to adjourn
and it passed unanimously.
