OF THE MEETING OF THE BOARD OF TRUSTEES
May
19, 2010
The
regular meeting of the Board of Trustees of the Northwest Mosquito Abatement
District was held 7:30 pm Wednesday, May 19, 2010 at 147 West Hintz Road,
Wheeling, IL.
There
being a presence of a quorum, Daniel R. Ansani, Vice President called the
meeting to order.
Trustees
present: Daniel R. Ansani, Vice
President and Assistant Secretary; Richard A. David, Secretary and Assistant
Treasurer; William Schneck, Treasurer; Karen V. Mills, Vice President and
Assistant Secretary/Treasurer.
Trustees
absent: Arnold D. Kincaid, President.
Also
present: Donald Veverka, Attorney;
Michael Szyska, Director.
The
minutes of the April 7, 2010 and April 21, 2010 meetings were read. William
Schneck made a motion to accept the minutes as read and Daniel R. Ansani
seconded the motion.
The
Secretary called the roll and all ayes had been cast for approval of the motion
and thereby declared the motion carried.
The
Treasurer's Report for April 2010 was presented and all checks were approved
for payment. Richard A. David made a
motion to accept the report as read and Daniel R. Ansani seconded the motion.

Richard
A. David made a motion to accept the Tax Anticipation Ordinance as presented by
Veverka, Rosen & Haugh, Attorneys for the District, and William Schneck
seconded the motion.
WHEREAS,
NORTHWEST MOSQUITO ABATEMENT DISTRICT has levied, in the manner provided by
law, taxes for the year 2010, the sum of $2,523,995.66; and,
WHEREAS,
due to the delay in collection of these taxes, there is not sufficient money in
the Treasury of the District to meet all necessary expenses and liabilities of
the District; and,
WHEREAS,
under these circumstances, the Board of Trustees may anticipate the collection
of said taxes to the extent of seventy-five percent (75%) of the amount of said
levy by the issuance and sale of warrants drawn against and in anticipation of
said taxes already levied;
NOW,
THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE NORTHWEST MOSQUITO
ABATEMENT DISTRICT:
1. That the President of the said Board of
Trustees is hereby authorized to execute and sell from time to time, as funds
are needed for the necessary expenses and liabilities of said District,
Warrants, in One Thousand Dollar ($1,000.00) denominations, drawn against and
in anticipation of taxes levied for the year 2010, in an amount not to exceed
seventy-five percent (75%) of this amount of said taxes. All of said Warrants shall be signed by the
President and countersigned by the Secretary under the Seal of the District.
2. That said Warrants shall be payable to bearer
and shall show upon their face that they are payable in numerical order of
their issuance solely from the anticipated taxes when these anticipated taxes
are collected and not otherwise.
3. Each Warrant shall bear interest, payable
only out of the taxes against which it is drawn, at the rate specified in the
Warrants. Said rate of interest shall be
set by the President of the time of the sale of each Warrant and shall not
exceed Two and Eight Tenths Percent (2.80%) per annum from the date of its
issuance until paid or until notice is given, in the manner provided by law,
that payment will be made upon presentation.
4. Said Warrants shall be issued in the
following form:

TREASURER OF NORTHWEST MOSQUITO ABATEMENT DISTRICT:
From taxes
collected under the tax levy for the year 2010, appropriated and levied for
Corporate purposes of NORTHWEST MOSQUITO ABATEMENT DISTRICT when received by
you, pay to Bearer the sum of ______________ Dollars with interest at the rate
of 2.80 Percent per annum from the date hereof until the date of payment or
until notice is given by publication in a newspaper or otherwise that the money
for the payment of this warrant is available and that it will be paid on
presentation. All warrants issued against
and in anticipation of said taxes are payable in the numerical order of their
issuance solely from said taxes when collected and not otherwise. Said warrants including this warrant, do not
exceed seventy-five percent (75%) of the tax levy and shall be received by any
collector of taxes in payment of the taxes against which they are issued.

5. Said Warrants shall be sold at not less than
par value thereof and the funds received shall be deposited with the Treasurer
of the NORTHWEST MOSQUITO ABATEMENT DISTRICT.
6. When the taxes levied for the year 2010 are
collected, the Treasurer of the NORTHWEST MOSQUITO ABATEMENT DISTRICT shall set
apart and hold out sufficient money for the payment of the Warrants outstanding
against said taxes together with interest thereon.
7. This ordinance shall take effect and be in
full force from and after its passage and approval.

Mr.
Veverka mentioned that the Prevailing Wage Ordinance will be adopted at the
June Board meeting.
Next
week Mr. Veverka will file a motion to dismiss the District from the Village
Green vs Arlington Heights TIF district lawsuit.
Mr.
Szyska highlighted several items from the staff reports. The crews started working overtime to treat
the extensive flooding after the rain.
There will probably be a major hatch in time for Memorial Day. The crews are hired and most have started
working. The District received the
Altosid products in March and the Natular should be delivered next week. Natular has been available for 15-20 years
and will be used in catch basins in the eastern half of the District. There is another product called 4 Star that
will be coming out in briquet form. Changing products will help prevent
resistance.
Mr.
Szyska mentioned that A J Gallagher made the changes to the insurance policy he
requested so the District went with their insurance (QBE, Essex & Torus).
Mr.
Szyska mentioned that two birds have tested positive for WNV (Carroll & St
Clair counties). This is early and
probably due to the warm April. The lab
has not collected many mosquitoes due to the cool weather.
Mr.
Szyska indicated that the Accountant has started the year-end audit.
Mr.
Szyska updated the Trustees on the NPDES federal and state permits.
There
being no further business to come before the Board a motion was made to adjourn
and it passed unanimously.
